There has recently been a change by the Property Ombudsman to the requirements surrounding agents & landlords going to inspect their rented properties. This now states that tenants must always give consent for a property inspection and agents cannot rely on assumed consent or by telling the tenant that if they do not hear from them they will enter using their own keys. This will cause problems for agents who are members of the Ombudsman scheme, particularly where the tenant has apparently left but the agent is unsure. It is common in such cases for the agent to carry out an inspection to find out whether the tenant is still there or not. Naturally since direct consent in these circumstances cannot be obtained the new code will make this impossible.
